Contract and Guarantee
This dog is free from any lien or encumbrance from stud fee, veterinarian fee, handling fee, etc. and is subject to all of the following terms and conditions. In this document the word dog shall apply to either sex.
1. The breeder guarantees the dog to be purebred, registerable with the American Kennel Club. Buyer agrees to register the dog with the prefix of C-Myste Baledwr SN by six months of age.
2. To the best of breeder’s knowledge the dog is in good health. If, however, within the first 72 hours (3 days) after the date of sale, a licensed veterinarian determines that the dog is suffering from a serious health defect or disease, the buyer may return the dog with a signed and dated certificate from the examining veterinarian, and the breeder at her option, shall offer a full refund or shall replace the dog.
3. If at any time the buyer decides that he/she cannot keep the dog, breeder has first right of refusal to purchase said dog at a mutually agreeable price not to exceed fair market value or the original purchase price. The dog may never be relinquished to any humane society or animal control facility, but must be returned to the breeder. Breeder agrees to accept the dog back at any age but with no guarantee of refund of purchase price except for replacement per item 8 below.
4. Buyer guarantees that the dog shall receive proper nutrition and veterinary attention.
5. Buyer shall provide to breeder within 30 days of receipt, copies of confirmation of any title, award, or certification earned by the dog
6. If, at any time, the buyer believes dog should be destroyed, the breeder must be notified and give approval. If the breeder requests the return of the dog in lieu of euthanization, the buyer must comply with that request. Upon the dog’s death, at any age, the breeder shall be promptly notified.
7. Buyer agrees to follow the guidelines established by the Cardigan Welsh Corgi Club of America when breeding this dog (Code of Ethics). Buyer agrees that neither the dog nor any of its offspring shall be sold to any commercial pet center (pet store, wholesaler, or puppy mill).
8. This dog is guaranteed to be free of hereditary defects adversely affecting its suitability as a companion or performance animal, as well as of faults that would be disqualifying for conformation as described in the Cardigan Welsh Corgi breed standard. Terms of replacement shall be as follows. For up to three years from the date of sale, breeder will replace the dog which, for hereditary reasons, is determined by the seller to be unsuitable as a pet. If the dog is to compete in performance events, buyer agrees to have radiographs or PennHip evaluation completed at one year of age or before the dog is permitted to do extensive jumping. Under no circumstance shall the dog compete in events that include weave poles before the age of 18 months. At any time radiographs or PennHip is done, buyer will provide seller with copies or results within 30 days.
9. Buyer agrees to show the dog at licensed AKC dog shows toward the goal of obtaining the dog’s championship. The breeder will provide whatever help, support, and education possible for the buyer to accomplish this goal. The breeder agrees, upon request by the buyer, to make appropriate recommendations of handlers that might show the dog. The buyer is responsible for paying for all show expenses, including but not limited to: handler fees, entry fees, maintenance, transportation, grooming, and all other costs involved in obtaining this dog’s championship. If at a later date the breeder and buyer agree that the dog is unlikely to complete its championship, this provision of sale shall be null and void with all other provisions remaining in force.
10. The buyer acknowledges that he/she has relied solely on his/her own evaluation of this dog in making the decision to purchase it. Information provided by seller was provided solely for the purpose of education, and does not constitute a separate warranty.
11. This document and the accompanying Bill of Sale contain the entire agreement between the parties. Terms thereof shall be modified only in writing.
12. Any dispute arising from the sale of this dog and the terms of this agreement shall be resolved in Jackson County, Oregon and governed by the laws of the State of Oregon.
