Contract and Guarantee

This dog is free from any lien or encumbrance from stud fee, veterinarian’s fee, handler fee, etc. and is subject to all of the following terms and conditions. In this document the word dog shall apply to either sex.

1. The breeder guarantees the dog to be a purebred dog registerable with the American Kennel Club.  Buyer agrees to register the dog with the prefix of C-Myste Baledwr SN by six months of age.

2. To the best of our knowledge the dog is in good health: if, however, the dog is found by a licensed veterinarian to be suffering from a serious health defect or disease within 72 hours (3 days) of the sale, the buyer shall return the dog with a signed and dated certificate from the examining veterinarian, and the breeder shall offer full refund.

3. If it is found at any time that buyer cannot keep the dog, breeders have first right of refusal to purchase said dog at a price not to exceed the original purchase price.   The dog shall never be relinquished to any humane society or animal control facility, but must be returned to the breeder.  Breeder agrees to accept the dog back at any age but with no guarantee of refund of purchase price after the 72 hour period except for replacement per item 6 below.

4. Buyer guarantees that the dog shall receive all proper veterinary attention.

5.  If the dog must at any time be destroyed, the breeders must be notified and give approval.  The dog must be relinquished to the breeder if so requested.  Upon the dog’s death at any age, prompt notice will be given to the breeder.

6. This dog is sold as a pet and there is no guarantee as to breeding or show potential. Terms of replacement shall be as follows.  Up to three years from the date of sale, a dog will be replaced if it exhibits a hereditary condition which reasonably makes it unsuitable as a pet.  If the dog will compete in performance events, buyer agrees to have radiographs or PennHip done at one year of age or before the dog is allowed to do extensive jumping.  Competition in weave pole events before the dog is eighteen months old will void all guarantees.

7. If female, the dog must be spayed by eight (8) months of age.  Males must be neutered by twelve (12) months of age. The dog is sold on an AKC limited registration, and therefore, no offspring of this dog will be registerable. On a limited registration, the dog will be able to participate in all AKC events with the exception of conformation classes.

8.  Buyer shall, within thirty days of receipt of verification of award, certification, or title, provide seller with copies of all such verifications of awards, certifications and titles earned by this dog.  Buyer also agrees that a current address and contact information will be provided to the breeders and updated promptly after any relocation.

9.  Buyer acknowledges that he/she has relied solely on his/her own evaluation of this dog in making the decision to purchase it.  Information provided by the seller was solely for the purpose of education and does not constitute a separate warranty.

10.  This document and the accompanying Bill of Sale contain the entire agreement between the parties.  Terms thereof shall be modified only in writing.

11.  Any dispute arising from the terms of this contract shall be resolved in Jackson County, Oregon, and governed by the laws of the State of Oregon.
